Thank you for using AI & Poem. These Terms of Use ("Terms") govern the AI poetry generation service provided at https://www.ai-and-poem.art/ (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, please stop using the Service.

1. Eligibility

You must be at least 13 years old. By using the Service you represent that you satisfy this requirement and can enter into a binding agreement. If you are a minor under the laws of your jurisdiction, you guarantee that you have obtained consent from your legal guardian; without such consent your access may be restricted.

2. Accounts and Access

The Service does not currently require a separate account. You are responsible for the security of the devices and networks you use, as well as for complying with applicable laws.

3. Permitted Use

• Provide accurate information and do not submit content that is illegal, abusive, defamatory, or infringes the rights of others.
• Do not attempt to disrupt, reverse engineer, compromise security, or collect data belonging to other users.
• Do not use the Service to generate content that violates Google AdSense program policies or other third-party rules.

4. Intellectual Property

The Service's user interface, brand, and underlying technology belong to AI & Poem and are protected by law. Topics you input remain yours. Generated poems are provided "as is," and we grant you a non-exclusive license to use them for personal or commercial purposes within these Terms and any usage limitations we publish.

5. Notice on AI-Generated Content

Poems are automatically generated from prompts you provide. We do not guarantee their accuracy, quality, or suitability; you are responsible for reviewing and using them responsibly.

6. Advertising and Third-Party Services

The Service displays Google AdSense advertising. Ads may appear based on contextual or cookie-derived signals. Any transactions with third-party advertisers occur solely between you and the advertiser, and we are not responsible for their content or offers.

6-1. Advertising Compliance

• Do not encourage ad clicks in any way (including self-clicks, incentives or rewards, baiting language, or deceptive placement).
• Do not use automated tools, scripts, or bots to generate ad clicks or impressions.
• Avoid UI placements that could be mistaken for content, and comply with Google AdSense program policies.

7. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review how we collect and use information.

8. Service Availability and Changes

We strive to provide a reliable Service but do not guarantee uninterrupted availability. We may update, pause, or discontinue the Service or certain features at any time. When we make material changes to these Terms, we will post the updated Terms with a new effective date.

9. Disclaimer

The Service is provided "as is" and "as available." We disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, AI & Poem and its contributors are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, or data arising from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless AI & Poem and its operators and affiliates from claims, damages, liabilities, or costs related to your use of the Service, except to the extent caused by our gross negligence or willful misconduct.

12. Governing Law

These Terms are governed by the laws of the Republic of Korea, excluding conflict-of-law rules. Any disputes shall be submitted to the courts located in Seoul, South Korea.
